Liveblogging Saddleback Forum: Obama fails judicial philosophy

Obama’s response to Warren’s question on which sitting Supreme Court justice he would NOT have nominated as president betrays prejudice and naivete.

His assertion that the primary role of the Supreme Court is to keep the Executive Branch from overreaching its powers and interfereing with the other branches (meaning the legislative branch primarily) betrays his total lack of understanding of Government 101. The Supreme Court exists – not to make law and not to police the presidency – but to interpret the Constitution and apply the law.

    By attacking Paul because he did not study law is a tu quoque fallacy. It does not address the argument of the origin and purpose of the Supreme Court. Ultimately, the truth or error of the matter should be the focal point of the argument.

  2. The Supreme Court exists for the very same reason the Presidency exits. To protect the Constitution.

  3. EDITING a law journal allows Obama to give an assinine answer to a straight forward question? As I said, Government 101 makes it clear that the Supreme Court exists to interpret the Constitution, not keep the president in check. Sorry hoosier. Obama should be even more embarassed at his assinine answer given the credentials you say he has.
